Job Description
PowerFlex, an EDF power solutions company, is a leading national provider of intelligent onsite energy solutions that support cost-effective and low-carbon electrification and transportation. We deliver integrated solar, storage, EV charging, and microgrid systems, to businesses and organizations. As a single full-service provider, PowerFlex customizes clean technology solutions to help clients achieve their energy and sustainability goals. Through the comprehensive PowerFlex X platform, based on proprietary technology, PowerFlex leverages patented smart software to control, monitor, and optimize a client's distributed energy resources to reduce cost and maximize return on investment. Our technology is deployed at scale to prominent commercial customers such as Adobe, DHL, Prologis, Target, and municipalities such as County of LA. PowerFlex is a top 5 provider in each of Commercial Solar, Storage and EV Charging in the US.
PowerFlex is seeking a Senior Counsel to support our fast growth in the on-site renewable energy business - focused on distributed generation Solar PV Energy, Battery Storage, Electric Vehicle Charging and related hardware and software technologies. In this position, you will work in close partnership with leadership stakeholders and internal business teams, to review and draft contracts, lead contract negotiations, and manage the full cycle of the business's internal legal needs.
Location
This role is open to be a hybrid role out of one of our offices (Mountain View, CA, San Diego, CA , Los Angeles, CA. or New York, NY) or a fully remote position.
Responsibilities
- 45% - Review and draft various contracts related to PowerFlex's business throughout the United States. Key contracts for the business include turnkey installation agreements for solar, storage, or EV chargers, power purchase or energy services agreements, and operation services agreements. Other contract types include software license agreements, vendor agreements, subcontracts, hardware sale or purchase agreements, site leases for installation (typically rooftop or parking lots), and project sale agreements.
- 20% - Interact with clients and counterparties, including leading negotiations and communications.
- 20% - Provide legal support and serve as the main point of contact for internal business and management teams for a variety of communications around contracting and legal matters; manage work streams for inter-company coordination; interpret and apply legal requirements to the business - in particular, laws and regulations relating to PowerFlex's activities; advise on contract strategies and provide risk and business arguments for specific deals and commercial issues.
- 10% - Develop and refine legal systems, contract templates, processes and playbooks, to continuously improve the health of the company's legal and compliance functions; manage workflow and provide reporting on all relevant activities; keep abreast of the company's vision, mission, and services, and competitive landscape, and be able to articulate the company's service offerings effectively.
- 5% - Other duties as assigned.
Qualifications
Education/Experience
- Juris Doctor degree and member of a State Bar Association (preferably California)
- 3-10 years of legal experience in relevant fields; preferably involving some familiarity with any of: renewable energy, distributed generation, technology, construction, project finance, or energy
Skills/Knowledge/Abilities
- Excellent listening and communication skills, both written and oral, including the ability to work with cross-functional business teams, and lead the drafting, negotiation and implementation of contracts
- Passionate about business results, with a strong sense of accountability, metrics and ownership
- Attention to detail, particularly while overseeing the full contract cycle
- Ability to multi-task and work in a deadline-driven, team-oriented environment
- Self-starter who can complete tasks and manage responsibilities with minimal supervision
- Advanced skills in Word, PowerPoint, and other Office products
- Proactive approach to organization
Compensation
The pay range for this position is $185,760 - $227,040 annually. This position is eligible for PowerFlex's comprehensive Health and Welfare plans including but not limited to medical, dental, vision, 401(k) retirement plan and paid time off. The total compensation for this position may include an annual performance bonus (or other incentive compensation, as applicable). PowerFlex's compensation packages carefully consider a candidate's qualifications, experiences, and education in relation to the position.
Physical Requirements
Remaining in a seated position. Long hours on computer keyboard. Prolonged periods of standing and/or walking.
Working Conditions
Approximately 90% of the time is spent in the office environment, utilizing computers (frequent use of MS Word, MS Excel, Outlook, Access, PowerPoint, Publisher and Adobe etc.), telephones, and general office equipment. Possibly 10% of the time is spent traveling to conferences or meetings or field traveling to project sites.
